If it ain’t broke…Association healthcare plans are working

In 1995, the Legislature passed a law to open up a more competitive market for small employers seeking to provide affordable, comprehensive health benefits to their employees and their families. This law allows greater access to health insurance coverage through association healthcare plans.
Few anticipated the tremendous success that would flow from this forward-thinking policy to broaden healthcare access for Washington’s employees.
Today, it is estimated that over a half million employees have healthcare coverage through their employer under association healthcare plans. It has opened doors that were essentially closed to many small businesses. In fact, some associations report that more than 40 percent of the employers participating did not previously offer health benefits.
While there is much room for improvement in our healthcare system, association healthcare plans are working.
To our members: I want you to know, throughout this current session, we will be keeping Associated Industries’ business owner-members informed if legislative proposals adversely impact your ability to provide healthcare for your employees through our association plans.
To our State legislators: As our policy leaders in Washington State, we encourage you to preserve and protect our critically important association plans that make healthcare available and affordable for hundreds of thousands of Washington families.

Department of Revenue seeks business input on tax simplification
In October of 2010, Governor Christine Gregoire directed the Department of Revenue to work with stakeholders to identify ways to simplify the tax code and reduce the burden and costs to small businesses.
Have an idea about how Washington State can simplify its tax system? The Department is currently in the process of scheduling meetings with stakeholders to gather information about the burdens and costs of complying with the tax system.
The State’s Department of Revenue has provided an online survey intended to supplement that process and ensure that ideas and feedback are received from as broad a segment of the small business community as possible. The Department plans to present its findings and recommendations to the governor by June 30.

REMINDER: Healthcare Tax Credit guidance available online
The small business healthcare tax credit, designed to encourage both small businesses and small tax-exempt organizations to offer or maintain health insurance coverage to their employees, is available to small employers that pay at least half of their employees' premiums. Small businesses can claim the credit for 2010 through 2013, and for any two years after that.
Form 8941 (Credit for Small Employer Health Insurance Premiums) and newly revised Form 990-T are available on IRS.gov along with instructions, FAQs and information clarifying the broad range of employers that meet eligibility requirements on the Affordable Care Act page on IRS.gov. MDI Marketing Account Executive, John Guarisco, received the Community Caring award at the Spokane Valley Chamber Gala January 22, 2011 in recognition of his active involvement in many organizations, including the Liberty Lake Rotary and the Center Pointe Board.

EEOC Retaliation Charges Eclipse Claims of Discrimination In mid-January the EEOC released statistics regarding its 2010 enforcement data, indicating that discrimination charges hit an all-time high, with 99,922 charges filed last year. The number of total charges has steadily increased since 2005, when the annual number of charges filed totaled 75,428. The majority of charges focused on race until 2010, when retaliation claims took the lead; comprising 36% of the charges. The EEOC also began enforcing discrimination based on genetic information, with GINA charges comprising only 0.2% of charges. Interestingly, out of nearly 100,000 charges, the EEOC only filed 271 suits in 2010, and found that 67% of charges filed had no reasonable cause. READ MORE |

IRS delays new nondiscrimination rules for group health plans
Recently, we warned of a provision in healthcare reform legislation that imposes new nondiscrimination standards on employer-provided group medical insurance plans. The provision prohibits “highly compensated” company executives or shareholders from receiving better healthcare benefits than “rank and file” employees – with very harsh penalties for violations (nondeductible excise tax of $100 per employee per day.)
Now the IRS has postponed implementation of this requirement, taking pressure off for the short term. The provision did not clearly define what represents discriminatory benefits in a group health insurance arrangement, so the IRS will reconvene to better clarify and provide administrative guidance in applying the rule.
